Terms of Service for ImmaShap

Please read these Terms of Service (“Terms”) carefully before using the ImmaShap mobile application (“Application”) developed by Axiom Array (“we”, “us”, “our”). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

1. Acceptance of Terms

By accessing or using ImmaShap, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be legally bound by them. ImmaShap is intended for adult use and is not directed at children. If you are under 18, do not install or use the Application.

2. Description of Service

ImmaShap is a personal safety and wellbeing application that:

Allows users to set scheduled check-in reminders.
Sends push notification alerts to designated emergency contacts if a user fails to check in within a configured timeframe.
Allows users to manually trigger an emergency alert or an “I am safe” notification to their contacts.
Provides an Emergency Numbers page listing emergency service and support line numbers for South Africa, Namibia, and Botswana, with an option to share the user’s current location through another app of their choice.

The Application is currently distributed in South Africa, Namibia, and Botswana.

3. No Emergency Services

ImmaShap is not an emergency services application.

ImmaShap does not contact police, ambulance, fire services, or any other emergency response organisation.
ImmaShap is not a substitute for calling emergency services. In a life-threatening situation, always contact your local emergency services directly:
- South Africa — Police 10111, Ambulance 10177, or 112 from a mobile phone.
- Namibia — Police 10111, or 112 from a mobile phone.
- Botswana — Police 999, Ambulance 997, Fire 998, or 112 from a mobile phone (112 may not work on all networks).
A fuller list for each country is available in the Application under the gear icon → Emergency Numbers (at the bottom of Settings).
ImmaShap does not place phone calls. Tapping a number on the Emergency Numbers page opens your phone’s dialler with that number filled in; you place the call yourself. Devices without calling capability (such as Wi-Fi-only tablets) cannot make these calls.
The Emergency Numbers page is provided for convenience only. Numbers are compiled from public sources and may change without notice, and some services may not be available in every area or at all hours. Private ambulance and rescue services listed may charge for their services. Short codes and toll-free numbers may not connect from a SIM card registered in a different country; if a number fails, try 112.
ImmaShap does not continuously track or monitor your location. Location is used only when you choose to use one of two features, and solely if you grant permission: for manual emergency alerts, a single one-time location snapshot is captured at the moment the alert is sent, to help your emergency contact locate you (this never applies to automatic missed check-in alerts); and when you tap Share My Location, your current location is obtained once and passed to the app you choose to share it with, without being stored by ImmaShap. 4. Limitation of Liability — Critical Notice

Please read this section carefully. It directly affects your legal rights.

4.1 No Guarantee of Delivery

ImmaShap relies on third-party infrastructure including Google Firebase, Firebase Cloud Messaging (FCM), and the Android operating system to deliver alerts. We cannot guarantee that:

Alerts will be delivered in all circumstances.
Alerts will be delivered within any specific timeframe.
Alerts will be received if the recipient’s device is offline, has notifications disabled, or has insufficient battery.
The Application will function correctly on all Android devices or Android versions.
The Application will continue to run in the background on all devices, particularly those with aggressive battery optimisation (e.g. Huawei, Xiaomi, Samsung with battery saver enabled).
Location data, where captured for a manual alert or obtained for Share My Location, will be accurate, available, or received within any specific timeframe. GPS signal strength, device settings, and permissions are outside our control.
The numbers listed on the Emergency Numbers page will be accurate, complete, current, or reachable from your device, network, or SIM card at any given time.

4.2 No Liability for Failed Alerts

To the maximum extent permitted by applicable law, Axiom Array shall not be liable for:

Any failure of the Application to send, deliver, or receive an alert for any reason.
Any inaccuracy in, or unavailability of, a number listed on the Emergency Numbers page, or any charge made by a private service listed there.
Any injury, death, loss, damage, or harm of any kind arising from a failure of the Application to function as intended.
Any reliance placed on the Application as a sole safety measure.
Any interruption, suspension, or termination of the service.
Any loss of data.

4.3 Use at Your Own Risk

The Application is provided as a supplementary safety tool only. Users accept full responsibility for their own safety and acknowledge that ImmaShap should not be relied upon as the sole or primary means of obtaining assistance in an emergency.

4.4 Maximum Liability

Where liability cannot be fully excluded by law, our total liability to you for any claim arising from your use of the Application shall not exceed the total amount you paid to Axiom Array for the Application (including any active paid subscription) in the twelve months preceding the claim. For users on the free tier who have not made any payment, this amount is zero (R0.00).

5. User Responsibilities

By using ImmaShap, you agree to:

Provide accurate information including your name and your emergency contacts’ email addresses.
Obtain explicit consent from any person you add as an emergency contact before adding their details to the Application.
Inform your emergency contacts about the nature of the alerts they may receive.
Not use the Application to send false, malicious, or harassing alerts to other users.
Not attempt to reverse engineer, decompile, or tamper with the Application.
Keep your Google account credentials secure.

You are solely responsible for ensuring that any person you add as an emergency contact has given their informed consent to:

Receive push notifications from ImmaShap on your behalf.
Have their email address stored in our systems for the purpose of receiving alerts.

Axiom Array accepts no liability for any dispute arising between you and your emergency contacts.

7. Subscriptions and Payment

7.1 Free Tier

ImmaShap is free to use. The free tier includes a limited number of manually-triggered emergency alerts each calendar month (currently 3, plus one additional alert per month if you exceed that limit), and displays advertisements. Automatic missed-check-in alerts and “I Am Safe Now” confirmations are never limited or restricted by tier, and remain fully available to all users regardless of subscription status.

7.2 Paid Subscription

ImmaShap offers an optional paid subscription that increases your monthly manual-alert allowance (currently to 30 per month) and removes advertisements. Current pricing is displayed within the Application and in the Google Play Store listing prior to purchase, and is billed in your local currency through Google Play. We reserve the right to change subscription pricing at any time; any price change will not affect a subscription period you have already paid for, and will only take effect from your next renewal, with reasonable notice where required by law.

7.3 Billing and Auto-Renewal

Subscriptions are billed and processed entirely through Google Play Billing on a recurring monthly basis, and automatically renew until cancelled. Axiom Array does not receive, process, or store your payment card or bank details — all payment information is handled directly by Google Play under Google’s own terms and privacy policy.

7.4 Cancellation

You may cancel your subscription at any time by tapping the $ button on the Application’s main screen, which opens your subscription in Google Play, or by going directly to your Google Play account subscriptions page. Cancelling stops future billing; you retain access to paid features until the end of your current paid billing period, after which your account automatically reverts to the free tier.

Deleting your ImmaShap account does not cancel your subscription. Your subscription is held against your Google Play account, not your ImmaShap account, so Google Play will continue billing you until you cancel it separately. If you delete your ImmaShap account and later sign in again with the same Google account, any subscription time still remaining is restored to you, together with the record of manual alerts already used in that billing period.

7.5 Refunds

All subscription payments are processed and billed by Google Play, and any refund is granted solely at Google Play’s own discretion under Google Play’s own refund policies. Google Play currently offers its own short buyer-initiated refund window (currently 48 hours from purchase); refund requests should be made directly through Google Play. Axiom Array does not independently review, grant, or process refund requests for subscription charges, and has no ability to override a refund decision made — or declined — by Google Play. Subscription fees are non-refundable by Axiom Array, as they grant immediate ongoing access to paid features for the billing period purchased.

7.6 Free-Tier Fair-Use Enforcement

To help ensure fair use of the free tier and to prevent circumvention (such as repeatedly deleting and reinstalling the Application to obtain additional free alerts), the Application may associate free-tier usage limits with your device as well as your account. See our Privacy Policy for details on the device identifier used for this purpose.

8. Account and Data

ImmaShap uses Google Sign-In for authentication. Your Google account is governed by Google’s Terms of Service.
You are responsible for maintaining the security of your Google account.
We reserve the right to suspend or terminate access to the Application if we reasonably believe these Terms have been violated.
On termination by us, your data may be retained for up to 30 days before deletion, after which it is permanently removed from our servers. Deletion that you initiate yourself, using Delete Account in the Application, takes effect immediately. Both are subject to the limited retention exceptions described in our Privacy Policy (Section 5), which cover free-tier fair-use enforcement and the record of a paid subscription you may still be being billed for.

9. Intellectual Property

The Application, including its design, code, graphics, and content, is the intellectual property of Axiom Array. You are granted a limited, non-exclusive, non-transferable licence to use the Application for personal, non-commercial purposes only. All other rights are reserved.

10. Advertising

The Application may display advertisements served by Google AdMob. These advertisements are governed by Google’s advertising policies. We are not responsible for the content of third-party advertisements. Advertisements are shown only to free-tier users; an active paid subscription removes advertisements for the duration of the subscription.

11. Modifications to the Service

We reserve the right to:

Modify, suspend, or discontinue the Application or any part of it at any time without notice.
Update these Terms at any time. Continued use of the Application after updated Terms are posted constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Nothing in these Terms removes, limits, or replaces any right you have under the mandatory consumer protection or data protection laws of the country in which you reside. If you are a consumer resident in Namibia or Botswana, you retain any rights and remedies granted to you by the laws of that country that cannot be excluded by agreement.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
