End User License Agreement (EULA) for ImmaShap

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Axiom Array (“Licensor”) for the use of the ImmaShap mobile application (“Application”). By installing or using the Application, you agree to be bound by this Agreement. If you do not agree, do not install or use the Application.

1. Grant of Licence

Axiom Array grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Application on Android devices that you own or control, solely for your personal, non-commercial use, subject to the terms of this Agreement.

The Application is currently distributed in South Africa, Namibia, and Botswana.

This licence is granted only to users who are at least 18 years of age. ImmaShap is intended for adult use and is not directed at children.

2. Restrictions

You may not:

Copy, modify, distribute, sell, or sublicense the Application or any part of it.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.
Remove, alter, or obscure any proprietary notices, labels, or branding on the Application.
Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
Use the Application to harass, threaten, or harm other individuals.
Send false emergency alerts through the Application.
Attempt to gain unauthorised access to any part of the Application’s backend systems or databases.

3. Ownership

The Application is licensed, not sold. Axiom Array retains all rights, title, and interest in and to the Application, including all intellectual property rights. This Agreement does not grant you any rights to Axiom Array’s trademarks, service marks, or logos.

4. Third-Party Services

The Application integrates with the following third-party services, each governed by their own terms and privacy policies:

Google Firebase (Authentication, Cloud Firestore, Cloud Functions, Cloud Messaging, Performance Monitoring, and App Check via the Google Play Integrity API) — Google Terms of Service
Google AdMob (Advertising) — Google Advertising Policies
Google Play (Distribution) — Google Play Terms of Service
Google Play Billing (Subscription Payments and Purchases) — governed by the same Google Play Terms of Service referenced above. Axiom Array never receives, processes, or stores your payment card or bank details; all billing is handled directly by Google Play.

Axiom Array is not responsible for the terms, policies, or practices of these third-party services.

5. Audio Attribution

One or more notification sounds used in the Application are sourced from notificationsounds.com and licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). Full licence terms: notificationsounds.com/license.

6. No Warranty

The Application is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose.
Warranties that the Application will be uninterrupted, error-free, or free of viruses or other harmful components.
Warranties that alerts will be delivered successfully or within any specific timeframe.
Warranties that the emergency numbers listed in the Application are accurate, complete, current, or reachable from your device, network, or SIM card.
Warranties that the Application will function correctly on any specific device or Android version.

You use the Application entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

Axiom Array shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Application.
This includes, without limitation, any failure to deliver an emergency alert, any inaccuracy in or unavailability of a listed emergency number, any personal injury or death arising from reliance on the Application, or any loss of data.
Axiom Array’s total liability for any claim under this Agreement shall not exceed the total amount paid by you to Axiom Array (including any active paid subscription) in the twelve months preceding the claim. For users on the free tier who have not made any payment, this amount is zero (R0.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless Axiom Array and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

Your use of the Application.
Your violation of this Agreement.
Your violation of any applicable law or third-party rights.
Any false or malicious alerts sent through your account.

9. Updates and Modifications

Axiom Array may, at its sole discretion:

Update or modify the Application at any time.
Change the features or functionality of the Application.
Discontinue the Application or any part of it without notice.

Updated versions of the Application may be subject to updated licence terms. Continued use after an update constitutes acceptance of the updated terms.

10. Termination

This licence is effective until terminated. It will terminate automatically if you fail to comply with any term of this Agreement. Upon termination:

You must cease all use of the Application and delete all copies from your devices.
Axiom Array may delete your account data from its servers within 30 days of termination, subject to the limited retention exceptions described in the Privacy Policy (Section 5).
Sections 3, 6, 7, 8, and 11 of this Agreement shall survive termination.

11. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the South African courts. Nothing in this Agreement removes, limits, or replaces any right you have under the mandatory consumer protection or data protection laws of the country in which you reside, including Namibia and Botswana. If you have a complaint or dispute, please contact us first at ImmaShap@AxiomArray.co.za and we will attempt to resolve it informally before any legal proceedings are initiated.

12. Entire Agreement

This Agreement, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Axiom Array regarding the Application and supersedes all prior agreements and understandings.
